LAGGING CHANGES: ADMINISTRATIVE PENALTY LIABILITY OF CONTRACTING AUTHORITIES AWARDING PUBLIC PROCUREMENT

ABSTRACT - This paper aims to investigate the possibilities for imposing administrative penalties to contracting authorities following public procurement audits. The acts for administrative violations drawn up by the auditors of the National Audit office are intended to influence the behaviour of the contracting authorities in such a way as to prevent future violations of public procurement procedures. The author investigates the formation and processing of administrative procedures by the control bodies by the National Audit Office of the Republic of Bulgaria and analyzes the changes in contracting authorities’ status in the amended PPA and the effects of the amendments for the imposition of administrative penalties for violations of PPA.
